These Terms of Service ("Terms") are a contract between you ("Merchant", "you") and Qaribuhub Solutions LTD, a company operating in Nairobi, Kenya ("Qaribuhub", "QaribuBot", "we", "us"), governing your access to and use of the QaribuBot website chatbot platform, including the marketing site, dashboard, chat widget, and related services (together, the "Service").
By creating an account, installing the QaribuBot widget, or otherwise using the Service, you accept these Terms in full. If you are accepting on behalf of a company, you confirm you have authority to bind that company, and "you" refers to that company.
QaribuBot lets you add an AI-powered chat widget to your website. The widget reads content from your website (pages you publish, and any FAQ text you add) and uses that content, together with a third-party large language model, to answer your visitors' questions.
QaribuBot is a tool that assists your visitors — it is not a guarantee of any particular business outcome, and its answers are generated by AI (see Section 8).
You must provide accurate information when creating an account (email, and where applicable, company name). You are responsible for all activity under your account and for keeping your login details and install keys confidential.
Each merchant account may register one or more websites, up to the limit shown in your plan. A given website can only ever be linked to one merchant account at a time — if a website is already claimed, you will need to contact support to resolve a dispute over ownership.
Install keys are shown in full only once, at the time they are created or refreshed. If you lose a key, you must refresh it from the dashboard; the old key stops working immediately once you do. You are responsible for updating the chatbot snippet on your site after a refresh.
You must not share your install keys publicly, use another merchant's keys, or attempt to exceed your plan's usage limits by using a key on a website you did not register.
You agree not to use the Service to: publish or facilitate unlawful, defamatory, hateful, or fraudulent content; collect sensitive personal data from visitors without a lawful basis and appropriate disclosure; distribute malware or attempt to compromise the security of the Service; scrape, resell, or sublicense the Service to third parties without our written consent; or use the Service for any website you do not have the legal right to operate.
We may suspend or terminate accounts that violate this section, with or without notice, particularly where suspension is necessary to protect other merchants, visitors, or the integrity of the Service.
Current plans and prices are shown on our Pricing page and may be changed by us from time to time; price changes will not retroactively apply to a billing period you've already paid for.
New accounts can start with a free trial on card checkout, or pay for a selected plan immediately. A valid card is required for a trial, and you are not charged at trial signup. The current trial duration and request allowance are shown from our live plan configuration before checkout. A trial can be used once per account. We will send a reminder before the trial ends. You can also pay with mobile money: those payments are prepaid in full for the plan you choose, and access begins once payment is confirmed.
Automatic enrollment after the trial: unless you cancel before the exact trial end displayed at checkout and in Billing, you will be automatically enrolled in the Starter, Pro, or Business plan you selected when starting the trial, at the price you accepted, and the card you provided will be charged on the trial end date. Doing nothing therefore results in a charge. You can cancel before the trial ends from the Billing page; cancellation prevents conversion but preserves access through the original trial end. See Section 4 of our Refund Policy for full cancellation details.
Paid plans (including a trial that has converted) are billed monthly in advance. Prices are shown in US Dollars (USD). Mobile money payments are settled in Kenyan Shillings (KES) at the prevailing exchange rate at the time of payment, and the KES amount charged will be shown to you before you confirm payment. Card payments are charged in USD or, where checkout localizes pricing for your country, your local currency, and the amount charged will be shown to you before you confirm payment.
Subscriptions renew automatically each billing period unless you cancel before the renewal date. For card subscriptions, we send a reminder roughly three days before each monthly renewal stating the package, price, renewal date, and how to cancel. If a renewal payment fails, your account may be marked past due. Access continues through the paid-through date shown in Billing, and you can restore it anytime by completing payment.
While a subscription is current, you may switch only to a higher package; buying the same package again or moving to a lower package before expiry is not permitted. Card upgrades modify your existing subscription rather than creating a second subscription and are charged immediately with proration. If you upgrade during a trial, the trial ends, the selected paid package is activated, and your card is charged immediately. Other plan changes may be made after the current subscription expires.
Refunds are handled under our Refund Policy, which forms part of these Terms — see qaribubot.com/refund-policy. In short: we offer a straightforward 30-day money-back guarantee on every paid plan payment, no questions asked.
If you initiate a chargeback or payment reversal with your bank, mobile money provider, or card issuer instead of contacting us first, we may suspend your account while the dispute is investigated, in addition to any rights the payment provider gives us.
You are responsible for any transaction charges levied by your mobile money provider, bank, or card issuer.
You retain all ownership rights in the content on your website and any FAQ text, product data, or other material you add to QaribuBot ("Your Content").
You grant Qaribuhub a worldwide, non-exclusive licence to crawl, store, index, and process Your Content solely to operate the Service for your account — principally, to let the AI widget answer questions using Your Content. We do not use Your Content to answer other customers' visitors. This licence ends when you delete the relevant content or close your account, subject to Section 12 of these Terms and Sections 7 and 8 of our Privacy Policy.
You confirm that you have the right to grant this licence — for example, that publishing your site content, and any FAQ text you add, does not infringe someone else's copyright or other rights.
When a visitor on your website chats with the QaribuBot widget, we process and store that conversation on your behalf so you can review it in your dashboard. You are responsible for ensuring your own website has an appropriate privacy notice covering your use of a chat widget and for obtaining any consents required under applicable law for the categories of data your visitors might share in chat.
Do not configure the widget, or instruct your visitors, to submit special-category personal data (for example health information, national ID numbers, or payment card numbers) through chat. QaribuBot is not designed to be a secure channel for that kind of data, and you are responsible if you invite visitors to submit it anyway.
The widget's replies are generated by an AI language model from Your Content, the latest crawl of your website, and the visitor's question. Like all AI systems, it can produce answers that are incomplete, out of date, or wrong (sometimes called "hallucination"), especially if Your Content is thin, ambiguous, or has not been re-crawled since you changed the live site.
QaribuBot is a communications tool. It does not create a contract, quotation, warranty, or professional advice (legal, medical, financial, or otherwise) on our behalf. Anything a visitor reads in the widget is published by you, on your website, under your brand.
You are solely responsible for reviewing the answers your widget gives (the dashboard lets you do this), for keeping Your Content and site reads accurate, and for correcting published pages or FAQ entries if the AI is answering incorrectly.
We do not guarantee that any specific answer generated by the widget will be accurate, complete, current, or fit for a particular purpose.
If you install the QaribuBot widget (or allow anyone to install it) on a website you operate, you — not QaribuBot and not Qaribuhub Solutions LTD — are the publisher of every message it shows to visitors. You control the websites, knowledge, persona, tone, crawls, and whether the widget is live.
You are solely responsible for: (a) the accuracy of prices, products, policies, hours, contact details, and any other facts the widget states; (b) consumer-protection, advertising, and e-commerce rules that apply to those statements; (c) any contract, booking, or reliance a visitor forms because of a widget answer; (d) complaints, chargebacks, regulatory enquiries, and claims by visitors or third parties arising from those answers; and (e) configuring the widget so it is appropriate for your industry (including not using it where a licensed professional must speak).
QaribuBot and Qaribuhub Solutions LTD do not monitor every reply in real time, do not approve your content before it is shown, and are not a party to your relationship with your visitors. Installing the widget is your decision; leaving it installed is your ongoing choice.
Operating QaribuBot requires us to rely on infrastructure and services operated by other companies, including: Google Cloud (hosting and sign-in); a card payment processor (currently Paddle.com Market Limited, as merchant of record); Safaricom PLC (Kenyan mobile money); and one or more third-party AI providers (to generate chat answers).
Your use of the Service is also subject to the applicable terms of these providers where you interact with them directly (for example, entering your PIN on your phone, or your card details on the checkout overlay). We do not control, and are not responsible for, outages or errors originating at these third parties, though we will make reasonable efforts to work around them.
The QaribuBot name, logo, and platform (excluding Your Content) are owned by Qaribuhub Solutions LTD or its licensors. Nothing in these Terms transfers any of our intellectual property to you, beyond the limited right to use the Service as intended.
You may stop using the Service and close your account at any time from Profile in the dashboard, or by contacting support. Closing your account is a two-step process: you request deletion and choose a reason, then we permanently delete the account three (3) days later. During those three days you can cancel from the email we send you (the "Cancel deletion" button) or from Profile. After the three days, we delete your account, profile photo, websites, knowledge, conversations, widget settings, team access, and login. Any paid subscription is cancelled immediately when the account is deleted. We keep payment amounts without your name, email, phone, or account identifier so our income records stay accurate, and we keep the date and reason for the deletion without your identity after deletion. Payment processors (card or mobile money) may retain their own transaction records as required by law; those copies are not under our control.
We may suspend or terminate your account for breach of these Terms, non-payment, suspected fraud or abuse, or if required by law.
On termination, your widget will stop responding on your site, and we will handle any remaining data in line with our Privacy Policy's retention and deletion commitments.
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by Kenyan law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement — except where such warranties cannot lawfully be excluded for consumer contracts.
To the maximum extent permitted by law, the total liability of QaribuBot, Qaribuhub Solutions LTD, and their officers, directors, employees, and agents to you arising out of or relating to the Service, however arising (contract, tort, statute, or otherwise), is limited to the fees you paid us for the Service in the three (3) months immediately before the event giving rise to the claim.
We are not liable for indirect, incidental, special, punitive, or consequential damages, or for loss of profits, revenue, data, goodwill, business opportunity, or anticipated savings, arising from your use of the Service — including loss arising from an AI-generated answer being inaccurate, incomplete, or relied upon by a visitor. Nothing in these Terms excludes liability that cannot lawfully be excluded, such as liability for death or personal injury caused by our negligence, or for fraud.
The limitation in this section does not limit your indemnity obligations under Section 15.
You agree to defend, indemnify, and hold harmless QaribuBot, Qaribuhub Solutions LTD, and their officers, directors, employees, contractors, agents, successors, and assigns (the "Indemnified Parties") from and against any and all claims, demands, actions, investigations, damages, losses, liabilities, settlements, penalties, fines, costs, and expenses (including reasonable legal fees) arising out of or relating to:
(a) Your Content, crawls, FAQ entries, widget configuration, persona, or any answer the widget gives on a site you control; (b) a visitor's reliance on those answers, including alleged misstatement of price, availability, policy, hours, identity, or contact details; (c) any contract, sale, booking, or representation a visitor claims was made through the widget; (d) your breach of these Terms or of any law (including consumer protection, advertising standards, e-commerce, intellectual property, and data protection); (e) infringement or misuse of a third party's rights by Your Content or by how you use the Service; (f) personal data your visitors submit in chat, or your failure to provide a lawful privacy notice or obtain required consents; (g) defamation, privacy, publicity, or similar claims about content the widget displays; (h) regulated advice (legal, medical, financial, or safety-critical) that a visitor alleges the widget provided; (i) your visitors', employees', or contractors' use of the widget; and (j) any third-party claim that the Indemnified Parties are responsible for harm caused by the chatbot on your website.
This indemnity covers claims by your visitors, customers, regulators, payment providers, and other third parties, in any forum, whether the theory is negligence, product liability, misrepresentation, breach of statute, or otherwise — except to the extent a court finally holds that the claim was caused solely by the Indemnified Parties' fraud or wilful misconduct.
You will not settle a claim that admits fault by, or imposes an obligation on, an Indemnified Party without our prior written consent (not to be unreasonably withheld). We may participate in the defence with counsel of our choosing at our own expense. Your obligations under this section survive termination of your account and these Terms.
We may update these Terms from time to time. If we make material changes, we will notify you by email or an in-product notice before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Kenya, save that either party may seek injunctive relief in any competent court where necessary to protect its rights.
